Complex Tax Credit & Incentive Matters: What Your Business Needs to Know
The Problem:
The US tax code is so broad and complex that no primary firm can stay current on all aspects, AND companies end up paying more taxes than they should when nuanced & complex credits/incentives are not attained.
EPAct 179D Energy Efficiency, Save Taxes
Now a permanent part of the tax code, tax deductions for energy efficient buildings are a great program and our team helps both those involved in their construction and owners qualify and get their filings submitted in partnership with their primary CPA.
What is the EPAct 179D Tax Deduction?
Also known as the Energy-Efficient Commercial Buildings 179D Tax Deduction, this program first came into existence in 2005 as part of the Energy Policy Act (EPAct).
Unlike other programs that align around the investment capital, 179D tax deductions center around the square footage impacted.
So a building that switches lighting to low energy may be able to qualify its entire interior footprint. CTA will be happy to talk you through the program on a free consultation.
Purpose of the 179D Deduction
The purpose of the program is to reward designers and commercial building owners for using energy efficient components in both new construction and renovations.
Examples of Energy Efficient Construction
The program specifically looks for energy efficient choices in:
- HVAC Systems
- Interior Lighting
- Building Envelope
Note that buildings that include solar panels should also consult with us about clean energy tax credits.
Who Should Consider a 179D Study?
Largely, the program has categories of beneficiary:
Commercial Building Owners
The program is designed to benefit for for-profit owners with accelerated depreciation. CTA helps quantify the materials that qualify for the deductions and prepare these studies.
Architects, Mechanical Engineers, Electrical Engineers, and Other Designers of Tax-Exempt Buildings
With a clear understanding that a huge percentage of our country’s largest buildings are owned by government entities, schools, and others, the program allows the credits on these construction and renovation projects to be collected by the firms involved in bringing them to life.
In 2023, the list of eligible tax-exempt entities for whom the designs may collect the deduction grew substantially and now includes:
- Charitable Organizations
- Churches & Religious Organizations
- Private Schools & Universities
- Private Foundations
- Political Organizations
- Other Non-Profits
- Native American Tribal Governments
- Alaska Native Corporations
- Public Schools & Universities
- Local Government Buildings
- State Government Buildings
- Federal Government Buildings
What Other Changes Came with the Inflation Reduction Act?
The benefit expanded to up to $5.36/square foot for buildings put in 2023 and $5.65/square foot for buildings put in 2024.

“I spent 24 years in public accounting…and during that time, I saw a need for very specialized services. Things that you would think a CPA firm would do, but they are not really staffed up for or have the right personnel to do….We want our employees to do two things:
We want them to do a very defendable and solid credit incentive delivered to the client.
And we also want them to be sure the client is happy while we do it.”
